ILTA’s 2014 Technology Survey: An Early Holiday Gift for the Legal Tech Community

2014 ILTA Technology SurveyNow that Black Friday and Cyber Monday are behind us, the best deal we see this holiday season comes from the International Legal Technology Association (ILTA) with their annual report, ILTA's 2014 Technology Survey. This granddaddy of legal technology deployment & usage benchmarks has it all … 454 law firms (33% of the ILTA membership representing more than 106,000 attorneys and 217,000 total users) responding to almost 200 questions about what technologies they are using to run their firms; expert commentary by ILTA staff and member firms to support the findings and useful technology trending and 'un' trending info based on 'compare and contrast' exercises with previous survey editions. And, oh yeah, if that hasn't sold you already, the entire 300 page PDF 'opus' is free of charge … a more than gracious ILTA legal technology community service gesture.

Randi Mayes, ILTA's Executive DirectorWhile we have not had the chance to dive in to the freshly published (released to ILTA members today!) findings, we did receive some survey themes from ILTA's executive director and tech survey 'MC' Randi Mayes worth sharing here:

Security: ILTA has seen a strong trend in security over the last few years, and it continues in 2014. Initiatives like security audits and web filtering have become the norm (now at 73% and 81% of responding firms, respectively,) and hard drive encryption (now above 50%) are becoming much more common. As the survey executive summary notes, to a large degree, firms' security agendas are being pressed by clients and regulators, and the recent government privacy and security sanctions of blue chip financial services and telecommunications companies will only accelerate security as priority #1.

  • Mobile Device Management (MDM) is up 12 points over two years. Per Jim McCue, Director of Information Systems at the Rodey Law Firm and contributor to the final survey findings … "with 54% of our firms not using a third party MDM and no product dominating market share, what a great opportunity for MDM vendors in legal right now. "
  • Multi-factor authentication: Up 5 points to 29%
  • Ethical wall protection this year broke the half-way mark to 55%
  • Encryption technologies are up across the board as well, from intrusion prevention to data loss prevention, to some of the second generation security solutions like AppLocker, Bit9 and FireEye (up 4% as a class.)
  • Information Governance continues to be important to firms, appearing as the second most popular response to our security challenges question, along with "Archiving, retention, retrieval" and other records policies appearing as the second largest concern as an email support challenge (29%).

Simplicity/fy: Based on survey findings, in particular the slowing of technologies the survey analysts thought would continue to rise like VDI solutions , the 'secret sauce' might well be the move away from complexity toward technologies that are easier to support, train, and maintain. Tasks or functions are also easier to outsource if simple, or at least standard, which could also be a driver.

  • While new Enterprise Search solution deployments are flat, many more firms are targeting SharePoint repositories, a 30% rise to 59%. This may be a function of simply leveraging tools and features firms already own and in the case of SharePoint 2013, leveraging the enterprise search functionality of the FAST search integration.
  • Litigation Support technology continues to grow with a 5% increase and in particular hosted (vs. on-premise) offerings are in high demand (up 16 points over 3 years)
  • Legal project management tools are still not being fully adopted with only 19% of respondents citing a specific solution.
  • Over a six year period, email management & security provider Mimecast has captured 85% of Google Postini's market share in legal and it's the new standard, with a whopping 48% of the overall market.
  • Laptop use is at its highest level ever with a median of 35% of attorneys using that technology in place of a desktop. Although Dell and Lenovo command a combined two-thirds of the laptop market, HP made strides this year and is up to 25%.
  • Since 2012, support for a single standard has risen back up to 34%, with another 15% looking for a single platform. The platform of choice today is ActiveSync, which provides a single connection technology for a variety of smart phones.

Save(ings): Cost reduction, or at least cost containment are still front and center. Budgets are still recovering from pre-2007 recession times so there is greater adoption of native utilities and slower migrations to the latest versions of main stream applications such as Exchange (2013) and Office.

  • Migration to Matter-Centric workspaces: After a steady rise to 64%, it seems to have hit a wall this year and remained flat.
  • Dictation technology: Nuance's Dragon's desktop installation had a huge year, rocketing up 12 points to 52% of respondents.
  • Air Cards are on the way down and Mi-Fi devices are ascending.

Top survey responses to the question regarding future trends, and 'game changing' technologies included cloud computing; "X" as-a-service; consumerization/mobility, and security/regulation. Many of these have already caused CIOs to scramble and re-prioritize while topics like mobility and security continue to simmer with the acknowledgement that the boiling point, although not reached yet, is not far off.

To summarize, ILTA's 2014 Technology Survey and its countless pages of statistics, analysis and trends is too important to ignore. Randi Mayes notes that the survey publication offers "a fairly good snapshot of where we are as an industry, and it provides useful insights into the direction particular technologies are trending." I think Randi and ILTA are too modest … these findings are an invaluable resource to anyone serious about engaging in our legal technology world. Let us repay the hundreds of law firm technologists who spend on average 1.5-2 hours to complete this survey, and the ILTA staff and member volunteers who spend hundreds of additional hours on analysis and narrative, by making the time to digest this report and engage our staff, clients and the legal community as a whole in an ongoing legal technology conversation. Time to unwrap. “Digital Signatures in Legal” Survey Reveals Healthy Demand for Compliant, Secure Technology

CoSign SurveyEarlier this summer, ALM collaborated with ARX, a global provider of digital signature solutions, to conduct a broad reaching poll among law firms and corporate legal audiences regarding their familiarity with and use of digital signatures. The “Signature-Dependent Processes & the Use of Digital Signatures in the Legal Market” Survey (report findings here) focused on usage and readiness to use digital signatures; efficiency impact of using digital versus physical signatures; factors of importance and concern when considering going digital; and departments most interested in versus most reluctant to use digital signatures.

To our surprise, 40% of the 200+ survey respondents indicated already using digital signatures and a total of 79% either use, are ‘planning to implement’ or ‘see the need’ to use digital signatures. Adoption is steadily increasing, especially among law departments (representing 45% of all respondents) with 41% saying they were most interested in implementing digital signatures.

According to the survey results, the top factors for selecting digital signatures included security and integrity of sensitive data (87%); ease of use (86%); ease of implementation (81%); acceptance by the courts (78%); and control over user management/governance policies (70%). 

While these selection priorities are for the most part aligned with broader legal trends … security, ease of technology use and information governance, the order of top digital signature benefits was a bit 'against the grain' with only 39% citing prioritized compliance with legal and audit requirements as a key benefit. On the opposite end, 62% cited increased efficiency (saving time on printing, etc.) as the biggest benefits of digital signatures; and 50% preferred shortened turnaround time on signature approvals. 

In digging in to better understand why legal compliance scored relatively low, we thought it relevant to point out that not all digital signatures are created equal. The survey focused on digital signatures, defined as anything that is not a wet (manual) signature, including both electronic and digital varieties.

Through our Envision Agency work with digital signature solution CoSign and its corporate parent ARX, we have learned the differences between digital and electronic signatures … many of which are based on portability, security, global digital standards and compliance. An apparent lack of differentiation and broader understanding between the two among survey takers might have been a contributing factor in terms of factors they value versus benefits they look for. 

As expected, the survey revealed that top digital signature deployment concerns include data security and integrity; control and location of sensitive data; acceptance/legality of digital signatures; and compliance with regulations/audit requirements. It's interesting to note here that while the top concerns mostly all pertain to security and compliance, many legal professionals are relying on basic electronic signatures … often a simple scanned signature and associated GIF or JPEG, to meet these needs. Again, a more thorough investigation of 'digital vs. electronic' might provide more clarity here.

1+1=3! The survey showed that while corporate legal departments are the most interested in implementing digital signatures (41%), (followed by law firm IT and Marketing) they are also the most reluctant to implement digital signatures (28%) (followed by the C-Suite and Finance).

So what's really behind this curious contradiction? A 'mere' education/knowledge gap or a technology/compliance deficit on the side of the digital signature providers? Based on what we have seen, heard and read, it's definitely an 'all of the above' and 'it depends' answer. It is no secret that highly regulated, standardized industries such as financial services, life sciences and pharma widely embrace digital signatures based on their adherence to globally accepted standards and document security protocols.

On the other hand, GCs working with their outside counsel who are extremely risk adverse when it comes to making a technology switch (such as 'paper to electronic' or 'electronic to digital') might just deem the effort involved in converting not worth it – either because the traditional physical signature is still considered the 'safest' or because nobody is doing the math to compute the big picture. What does adding 1.24 days to signature processes due to waiting on signed documents do to the bottom line? How much financial and environmental resource waste does the stat '49% of all documents are printed for the sole purpose of obtaining a signature' amount to?   

In an age, where cost cutting, increased productivity, streamlined operations, mobility and compliance/security are all red hot buttons, embracing a digital signature strategy seems like a natural progression.

2014 ILTA/InsideLegal Technology Purchasing Survey Delivers Promise … Increased Tech Spend

On Monday (August 18th) of ILTA 2014 week, we released the 2014 edition of our 9th annual ILTA/InsideLegal Technology Purchasing Survey as part of our 11th annual ILTA Vendor Education Program. The 2014 survey set records for ILTA member participation and the results indicate a more 'sunny side' of #LegalIT spending, budgets and overall engagement (pronounce it french … sounds better :-)) when it comes to legal technology selection and purchasing. Like every year, we are more than impressed by ILTA members and their willingness and even eagerness to mention consultants who they work with (122 companies in 2014) and vendors who provide exceptional customer service (124 vendors in 2014). 

The 2014 survey, the 9th edition of this ILTA/InsideLegal collaboration, garnered a 20% response rate with 281 unique ILTA member firm responses. The 31 question web-based survey was distributed to 1,407 ILTA member law firms. 86% of all responses came from the U.S., 8% from Canada, and the remaining 6% a mix of the U.K., Europe, Australia and South America.

2014 Survey highlights include:

  • 54% of all respondents, including 72% of ‘Over50’ firms, spend 2-4% of total firm revenue on technology
  • 62% of all responding firms spend more than $8,000 on technology per attorney; 61% of ‘Under50’ firms spend less than $8,000 on technology per attorney
  • Top technology purchases among all surveyed firms in 2014 include: laptops/notebooks (64%), desktop hardware/PCs (63%), network upgrade/servers (50%), printers/multifunctional devices (47%) and antivirus/antispam/spyware software (41%)
  • Over50 firms dominated purchases in several application areas including analytics software; docketing/calendaring; electronic discovery software; HR management software; mobile device management and workflow automation
  • Based on survey responses, internet research, peer recommendations and consultants are the top influences for legal IT purchasing decisions
  • 76% of survey respondents have not worked with an industry/research analyst
  • Big data planning: 10% of all respondents are working on formalizing their big data strategy and an additional 6% already have a big data plan in place
  • 90% of respondents rely on outside consultants to assist with some aspect of firm operations, technology and infrastructure
  • 91% of surveyed firms’ attorneys use tablets as part of their day-to-day work
  • 86% of survey respondents indicated that they either have a formal mobile device security policy in place or are establishing one
  • Outside of the IT department, attorneys (80%) most frequently request technology purchases followed by Firm Administration (53%) and Practice/Litigation Support (31%)
  • Top answers to the open-ended ‘most exciting technology or trend’ question included mobility (e.g., tablets, mobile device management); cloud services, specifically –as-a-Service models including analytics, disaster recovery, security, and DMS; virtualization; and wearable technologies.

AALL Big Data Panel: Discussing Big Data Opportunities with Firm Partners

Three objectives were set for the program:

  1. Provide an overview of big data and share tips and best practices for planning and executing a big data project including where to start and who to involve.
  2. Have attendees gain a deeper understanding of big data’s current and future role in the legal profession, and learn about specific legal big data scenarios that will broaden this understanding – and perhaps even inspire projects of their own.
  3. Provide a list of tools and resources (many that they already own) which can serve as big data “kick-starters.”

We really enjoyed our first visit to the AALL Conference and would like to thank our fabulous panel for their time and assistance in developing the program as well as ILTA/TJ for her assistance and work coordinating all the education as part of the technology/ILTA track.
