Mary Pat Poteet with DLA Piper US LLP.  I am the Director of Litigation Support.

What is your firms’ specialty/niche? 
DLA Piper became one of the largest legal service providers in the world in 2005 through a merger of unprecedented scope in the legal sector. While large in scale, the merger strategy was simple – to create an international legal practice capable of taking care of the most important legal needs of clients wherever they do business.

What do you see as the biggest challenge facing the legal technology industry now and in the upcoming year?
Biggest challenges right now is identifying the right technology for the dollars available.  Budget constraints have made technology acquisitions difficult.

How can the legal vendor community work with you best?
Email!  Phone calls are extremely disruptive where as email can be tagged and flagged for follow up!

What advice would you have for legal vendors trying to compete in this crowded marketplace?
Don’t tear down your competitors.  Tell me how you are different – what sets you above the others and makes you more valuable.

Total Attorneys Acquires Virtual Law Office Technology

Total Attorneys, Inc. has announced the acquisition of Virtual Law Office Technology, LLC

CHICAGO–(BUSINESS WIRE)–Total Attorneys, Inc., a managed-services provider that helps small law firms and solo practitioners, announced today its acquisition of Virtual Law Office Technology, LLC (VLOTech). Based in Wilmington, N.C., VLOTech provides a secure, web-based interface that streamlines the delivery of legal services to consumers and businesses.

Safety/Liability – Important to Remember

  • You are not invisible online. Remember that when following competitors, etc.
  • Everything you say and do online matters. This is very important to know, especially if you have employees tweeting about your company.

Even if you aren’t tweeting now, log in and reserve your name/company name for free now before someone else does!

Tips on Content – What to Tweet

  • "Be transparent, be useful and be truthful. If all I'm seeing is marketing, I'm not going to read your blog or tweets." Jenn Steele
  • Use twitter to link to your blog.
  • Pick two avenues of social media and do them right rather than spreading yourself too thin.
  • If you are a vendor using Twitter, it's important to brand your background.
  • Most important thing is to make sure content is useful, not just sales.

Twitter-quette – Don’t Wear Out Your Welcome!

  • Don't send 20 tweets in a row.
  • A bit of personal information humanizes you and allows people to get to know you, but avoid TMI. People aren't interested in what you have for breakfast or your excessive minute-by-minute commentary on a game or concert.
  • Leave room for people to re-tweet (RT) you. It will make people more likely to RT you. (remember you only have 140 characters per tweet including RTs) 

Tweet Search Tool Recommendations

Getting started with twitter searches on your product or brand are easy ways to dive in. There are many Twitter tools and utilities and we will be covering more in InsideLegal's upcoming Twitter Starter Guide, but for now, here are 4 of my favorites…

  • TweetDeck – Popular choice for tracking and posting to Twitter.
  • TweetBeep – Operates like Google Alerts for Twitter. You can setup a free account to monitor Twitter for any mentions of your company/product – even if you don't have a Twitter account.
  • OutTwit – A tool that brings Twitter into your Outlook for easy use.
  • Twitter Search – Searches Twitter posts just like Google searches websites.

“In Their Own Words” Legal Thought Leaders Spotlight: Allison Shields

Allison Shields Who are you?  Who is your organization?
I am a former law firm partner with over 12 years of full time litigation experience. During that time, I became very interested in management and business development – topics most lawyers aren’t focused on. I realized that good systems, practice management strategies and effective business development methods can make all the difference in a successful, productive and enjoyable law practice. I started Legal Ease Consulting to prevent the defection of good lawyers from the profession and to help them rediscover the reasons they chose law in the first place; just because law is a serious profession doesn’t mean lawyers can’t enjoy themselves too. 

Where does your organization fit in the legal industry?
As a former law firm partner and entrepreneur, I’m aware of the burdens involved in dealing with the ‘three headed monster’ of the competing demands of administrative, marketing, and client tasks that require a lawyer’s attention. Often, the problem isn't knowing what needs to be done -  it's actually getting it done. I’ve see firm struggle with practice management and business development implementation due to a failure to plan strategically or a lack of accountability. I help lawyers to create a vision for their firm, and then strategize about how to reach that vision by creating plans, action steps and accountability that actually help them to get things done.

What do you see as the biggest challenge facing the legal industry now and in the upcoming year?
The legal industry is at a cross-roads which has been building over time, but has been accelerated by the economic crisis. Unfortunately, the current state of the legal profession – the billable hour model, pressure to work ever longer and harder, increased competition – works against the best interests of lawyers and their clients. Lawyers have even more pressure to become more efficient and effective, to establish and articulate the value of their services to their clients, and to develop alternative fee structures. Clients will continue to be vigilant in reviewing bills and challenging lawyers to provide services in ways that suit the clients – and that includes the ways in which legal fees are charged, as well as the way the work is performed (and by whom).

How can law firms work with you?
Legal Ease Consulting, Inc. offers a variety of coaching and consulting services and products. Services are offered either on a project basis with a defined scope or through ongoing monthly retainers, based upon the individual client’s needs, resources, budget and goals.

I work with clients in four crucial areas: Planning and Strategy, Procedures and Systems, Business Development/Client Experience and Culture and Professional Development. I help lawyers create a vision for their practice and develop plans to reach that vision; improve productivity; set goals; develop more effective office procedures; and create alternative fee structures and refine billing and collections. I work with clients to identify and attract their ideal clients; manage client expectations; enhance client experience and increase referrals; build client and employee satisfaction surveys and policies; revise compensation plans; and improve firm communication.

How can the legal vendor community work with you?
I can work with legal vendors by writing white papers and presenting teleseminars, webinars or live speaking engagements. I can also work with legal vendors on projects with their lawyer-clients. As a lawyer and former law firm partner, I have experience working in both small and mid-sized law firms, and I know the unique challenges faced by lawyers in managing and marketing their practices, and the restrictions they face, which aren’t always present in other businesses.

How can you help legal technology vendors be more successful?
Lawyers and law firms are notoriously slow to adapt to new technologies, and they are naturally skeptical of being ‘sold’ anything – especially technology. They have concerns about privacy, security and their ethical responsibilities to clients, and they are reluctant to spend time on anything ‘non-billable.’ All of these factors combine to make lawyers difficult to convince about the virtues of technology and how they can be used in their practice. As a former practicing lawyer, I can help legal technology vendors be more successful by helping to identify some of the challenges faced by lawyers and identifying the benefits of technology and how technology can improve the lawyer-client relationship and the lawyer’s bottom line.

“In Their Own Words” Legal Innovators Spotlight: Matt Homann

Matt HomannWho are you?  Who is your organization?
I’m Matt Homann, and I’m the founder of LexThink, a legal innovation consultancy.  I’m a former lawyer and mediator and the author of the [non]billable hour blog. I regularly write and speak about ways lawyers can use innovative ways to build their practices, serve their clients better and make more money.

Through LexThink, I design, facilitate and host retreats and legal conferences.  I also facilitate high-stakes meetings and brainstorming sessions for non-legal companies like Microsoft, Sungard, HP, McDonald’s and the Marine Corps.

Where does your organization fit in the legal industry?
That’s a difficult question for me to answer, because LexThink does a variety of things traditionally offered by a range of service providers: including marketing gurus, strategy coaches, firm management consultants, retreat facilitators, trainers, and keynote speakers.  Instead, I prefer to say that I make lawyers and meetings better — and often at the same time.

What do you see as the biggest challenge facing the legal industry now and in the upcoming year?
Most lawyers are focused on returning their practices to profitability — which is a near term problem for many of us.  However, I think a far greater challenge is looming in the distance, and that is irrelevance. 

For far too long, lawyers have taken their clients and customers for granted.  Quietly, real alternatives are emerging that are making lawyers less necessary to clients.  In just the last five years, we’ve seen more and more consumers turn first to the web as they draft their will, start their LLC, etc.  This is a trend that will only continue, and lawyers must begin thinking about a day when the least valuable thing they have to offer their clients is advice.

How can law firms work with you?
My ideal law firm client is looking for a unique, innovative and creative firm-wide or practice group retreat that focuses on real problem solving, collaborative brainstorming and team building. 

For example, I’m working with a firm right now to build a client-focused retreat for a practice group.  We’re going to invite actual clients of the firm to work alongside partners, associates and staff as they design and build a better customer service experience.

I speak at firms about innovation, creativity, marketing, alternative pricing and social media.  From time to time, I will also work with individual lawyers to help them think differently about their practices.

How can the legal vendor community work with you?
I can design and facilitate unique, fun user meetings and focus groups, and am already working with a few legal vendors to help them better understand their audience and improve their “pitch.”

I’m also building a two-day, immersive “Vendor Value Experience” that will use a variety of methods (including collaborative brainstorming exercises and visual facilitation) to help vendors better understand their trade-show audiences, re-evaluate their conference presence, improve their value proposition and hone their “elevator pitch.”  I’ll be launching this in November.

Marketing Manager – US & Canada
Global legal technology vendor with 900+ clients worldwide is seeking a ‘Marketing Manager – US & Canada’ to continue to drive dynamic growth into the North American professional services markets. Based out of Chicago but liaising closely with international HQ, the Marketing Manager will be responsible for marketing planning & budgeting, PR agency liaison, telemarketing management, press release/case study drafting, devising sales campaigns & promos, partner marketing, social media, and all aspects of lead generation (events & trade shows, direct mails, webinars, etc). The Marketing Manager will also recruit a full time Marketing Assistant once on board and has gained a feel for requirements. Salary $60k to $65k, depending on experience. Minimum of 5 years applicable marketing experience. Additional experience of Mobile App marketing or B2B marketing across other sectors, not just legal, preferable but not essential. This role is suited to a highly driven self starter, used to working with a team of regional sales managers, who can demonstrate they have made a clear commercial impact through buzz marketing and lead generation in previous roles.

Lead Generation Marketing: Converting RSVPs into Attendees

As anyone familiar with marketing knows, a majority of marketing initiatives are conceived to generate leads and ideally sell, or at a minimum, greatly assist in selling a company's goods and services. The legal technology industry is no different. In fact, according to the 2008 InsideLegal.com Legal Technology Vendor Marketing Survey, 79% of all marketing programs have lead generation as the primary goal. With this in mind, it is helpful to differentiate between lead generation that results in a face-to-face meeting, a product demonstration, or a seminar RSVP, compared to leads that are aimed at closing deals, bringing in new business, and directly impacting the bottomline. 

In this case, we'll focus on 'indirect' lead generation in the form of event attendance. How many times have you produced an event - a webinar, a 'lunch and learn', or perhaps a one day workshop- and waited with baited breath for the RSVPs to roll in. Then, once you straddled the RSVP hurdle you were even more anxious about ensuring adequate attendance (actual 'live bodies') to your event. Typically, the correlation between RSVPs and actual day-of event attendance is determined by event type, event venue (or access), event cost, and overall goodwill gained by attending or ill-will earned through absence. Here are some observations as it relates to legal event RSVPs vs. attendance: If producing a webinar, the further in advance you send the initial invite, the smaller the overall attendance (people usually don't plan webinars or web sessions more than a week or so in advance). If producing a complimentary webinar and relying on evites/HTML invites, a majority of RSVPS will occur on the first day the invitation was sent. Email reminders for webinars sent between 3 days prior and up to 3 hours before are most effective. For seminars and educational programs offered free of charge, the RSVP-to-attendance conversion rate is commonly less than 50% and influenced by many factors including event content, ease of getting to venue and length of event, allegiance to the event host/producer (aka 'the guilt factor'), and overall competition from other events or invites.

While there is no silver bullet or magic formula for increasing your RSVP-to-attendance conversion ratio, there are several tips that will guarantee you have adequately covered all your promo and marketing angles (and hopefully result in better attendance):

Set the tone with professional invites and follow-through: Your invitation is often times your first point of contact with your prospects so make sure you are sending out very professional, appealing content that clearly articulates your value proposition and answers the attendee's main question: "what's in it for me?" Once RSVPs are received, make sure you acknowledge receipt and confirm attendance (usually handled by auto-response emails).

Preach value as well as exclusivity: When you send a follow-up or reminder to the initial invite, add unique content tidbits to further entice attendance and to communicate exclusivity of this 'invite-only' event.

Rely on grassroots (word-of-mouth) promotion using social media: While it is not realistic or advisable to blast the invitees with pre-event reminders and 'save the date' messages, it is possible to use social media tools such as LinkedIn, Facebook and Twitter to not only extend your invitation scope but to intelligently 'tease' and preview content attendees will be privy too. For example, if you are inviting legal IT executives to attend a webinar focused on presenting results of a recent IT Budgeting and Purchasing survey, use LinkedIn to provide pre-webinar polls, leverage Facebook to sign up 'fans' and encourage conversation about some of the survey toplines, and tap into twitter to send out short (all you have is 140 character anyway), thought provoking statistics and survey factoids (and web invite links) to your followers and potential webinar attendees. Beyond social media, good old fashioned 'door-to-door' tactics might work well, venue permitting. For example, we recently hosted a tradeshow vendor education program and went booth-to-booth the morning of the event to remind RSVP(ers) and others who had not heard anything about the event.

Tap into your 'social' network: Most events often involve external speakers, panel participants, and lecturers- all of whom are very vested in your event and want nothing more than to draw a big crowd and fill those seats just like you. With a little planning and foresight, you can collaborate with your content providers and have them help promote your event, in some cases to the same crowd you are reaching, in other cases to a whole new group of prospects you might not have thought of or had access to.

Reward RSVPs that attend: Do not take attendance to your events for granted. Consider that your audience will always have a reason to not attend (they'll have more reasons during the economic downturn), but rather seek the event presentation notes and other leave-behind. Reward your attendees for coming with an exclusive gift, acknowledgement, hand-out or other give-away.

At the end of the day, and before you start serving your pre-event continental breakfast, you want to feel good about the outreach and promotion you have engaged in beforehand. If you follow-through on some of the common sense methods above, you'll be able to not only fill more seats at your events but build valuable, hopefully long-term relationships with your prospects.

Note: InsideLegal decided to 'eat our own dogfood' and follow the aforementioned RSVP-to-attendee conversion tips when producing our recent ILTA Legal Vendor Education Program. The result: We received 135 RSVPs to our 3 hour long educational track, and counted actual attendance in excess of 95 through various panel discussions offered as part of the program.
