Ari Kaplan Advisors is recognized for its legal industry research on issues related to in-house and outside counsel, as well as the those of interest to the overall community.  We also focus on ghostwriting white papers, case studies, client profiles, client alerts and articles.

What do you see as the biggest challenge facing the legal technology industry now and in the upcoming year?
Providing tools and services that support the alignment of interests between corporate legal departments and law firm attorneys.

I write about perspectives in the industry for the Law.com Legal Technology blog.  I am always interested in discussing trends and developments.

What advice would you have for legal vendors trying to compete in this crowded marketplace? 
Focus the discussion on value and clearly demonstrate the benefits of collaboration.

“In Their Own Words” Legal Thought Leaders Spotlight: Carole Levitt & Mark Rosch

Carole Levitt and Mark Rosch. President and Vice President (respectively) of Internet For Lawyers. We are full-time MCLE program presenters.

What is your firms’ specialty/niche?  

Internet For Lawyers provides regional, local & specialty Bar Associations, law firms and corporations from Alaska to Alabama, with turn-key continuing legal education seminars covering free and low-cost research resources on the Internet, and technology tools for lawyers. We spend our entire days scouring the Internet to locate and test new sites and resources so we can point lawyers directly to the most useful ones.

What do you see as the biggest challenge facing the legal technology industry now and in the upcoming year?

The Internet has changed the way legal professionals conduct research.  Rule 1.1 of the ABA's Model Rules of Professional Conduct states that, "Competent representation requires the legal knowledge, skill, thoroughness and preparation reasonably necessary for the representation." While it doesn't specifically say that, "lawyers have a duty to 'Google'," the reality's not too far from that. The legal technology industry needs to help practitioners differentiate and utilize the best options for caselaw, factual, public record, and other types of information that are now available.  

How can the legal vendor community work with you best?

We're always interested in learning about new technology tools that will help lawyers work "smarter, not harder" for inclusion in the "Technology A-Z" seminars we present on tools and tips lawyers can use in their practices. We also include articles about these kinds of tools on our Web site. For example, we were among one of the first sites to write about the ability to conduct caselaw research in Google Scholar and have received a lot of positive feedback from readers on the details we provided.

What advice would you have for legal vendors trying to compete in this crowded marketplace? 

Don't ignore the vast majority of attorneys in this country who work in solo or small firm practices. 

What associations are you active in?

Currently: ABA Law Practice Management Section; Association of Continuing Legal Education (ACLEA); Previously, Carole was Chair of the California State Bar Law Practice Management & Technology Section, and Vice President of the Southern California Association of Law Libraries.

What online resource (website, blog, etc.) is most useful to you (i.e., you use it everyday)? 

Carole: Google. It (almost) never fails to help me find the information I need. Mark: Twitter. It has been an excellent source of (professional) current awareness reading.

What are you speaking about at TECHSHOW?

We're doing one program together – a "Meet the Authors" session tied to the upcoming release of two new books published by the Law Practice Management Section. The first book, titled "Find Info Like a Pro" is a hands-on guide that shares the secrets, shortcuts, and realities of conducting investigative and background research using the sources of publicly available information available on the Internet. Written for legal professionals (but also useful for anyone who needs to conduct investigative and background research), this comprehensive desk book lists, categorizes, and describes hundreds of free and fee-based Internet sites. The resources and techniques in this book are useful for investigations; depositions; locating missing witnesses, clients, or heirs; and trial preparation, among other research challenges facing legal professionals. 

The second book, titled "Google: The Search Box and Beyond," is a step-by-step guide to using both Google's most-popular and also its newest and least-known search features, productivity tools, and services.

Mark is also co-presenting the "Google Tools for Lawyers" session separately with Dan Pinnington.  It will cover some of the material contained in our book Google: The Search Box and Beyond, such as Google's Web search, free productivity tools and services like Gmail, Google Docs, and Google Voice.

For the second year, InsideLegal is producing the Legal Vendor Education program at ABA TECHSHOW courtesy of the ABA Law Practice Management staff and board. “In Their Own Words” Legal Thought Leaders Spotlight: Ben Schorr

BenSchorrWho are you?  What firm are you with?  What is your role?
I’m Ben M. Schorr, the CEO and CTO of Roland Schorr and Tower. In that capacity I lead a team of talented and enthusiastic folks who love to solve problems for our clients. Aside from managing the team I also take a hands-on approach to some of our clients problems, and spend a lot of time listening to what their issues are and offering advice.

What is your firms’ specialty/niche?  
Our specialty really is in what is often called “Decision Support Systems” though I like to think of it more generally as “Helping our clients be more effective.” We help our clients not only with the technology (servers, network infrastructure, applications) but also with the procedures and techniques of using these systems to be better at what they do.

What do you see as the biggest challenge facing the legal technology industry now and in the upcoming year?
The move towards alternative billing has gained a lot of steam and this is invoking a serious shift in the mindset for a lot of firms. In the past there was a certain amount of complacency among firms when it came to making their processes inefficient because the billable hour was their stock in trade. There wasn’t as much incentive to finish a document in half the time because it meant half the money. Now the game has changed somewhat as clients increasingly insist upon alternative billing and are increasingly price sensitive. Now it behooves firms to be as efficient as possible and, in fact, it’s MORE profitable to do the same document in half the time because you can now do twice as many of them.  In an alternative billing arrangement that leads to a higher effective hourly rate and even more profits for the firm.

So legal technology has stepped right into the fray, providing firms with the tools to be more effective and more efficient. To accomplish more tasks, with consistently higher quality, using fewer staff resources in less time. The challenge for us is to continue to refine those tools and processes to make them as good as they can be, but also to help lawyers and legal staff use them to the best of their abilities.  The training issue has hovered over us for decades – getting attorneys and staff to use the tools well.

How can the legal vendor community work with you best?
Content is king. If a vendor wants to work with us or our clients they need to convey clearly, completely and concisely how their product or service is going to help our clients be better at what they do and that there is a clear return on investment for going with them. Vendors need to be accessible and candid.

What advice would you have for legal vendors trying to compete in this crowded marketplace? 
You’ve got to have a message and you’ve got to get that message out. Events like TECHSHOW are a great way to showcase your firm and your product. Social media can help to get your message out – blogs are still valuable, Twitter, LinkedIn and even Facebook. Learn from folks like Rick Borstein at Adobe who gets out there and makes himself a valuable resource for firms. Don’t make your customers or potential customers have to work too hard to figure out what you do and how you do it.

What associations are you active in?

American Bar Association
; I’m a Microsoft MVP; and an active member of the Mid-Pacific Road Runners Club and USA Triathlon.

What online resource (website, blog, etc.) is most useful to you (i.e., you use it everyday)? 
I’m a black belt in Google-Fu; I probably do more searches a day than any human alive. That said the sites I find most professionally useful are probably Slashdot.org; you get a lot of interesting insights from a lot of smart nerds, and Microsoft Answers.

What are you speaking about at TECHSHOW?
I’ll be presenting a session called “ESQ Anywhere” with Sonnenschein’s Eric Anderson about technology for lawyers to use on the road. Also I’m co-presenting a session called “Power Users: Outlook” with Xavier Beauchamp-Tremblay, the man with one of the coolest names in law technology. We’ll be offering some more advanced tricks, tips and techniques for working with Microsoft Outlook.  Finally I’ll be doing a “Meet the Author” session where folks can come and talk to me about either of my books: “The Lawyer’s Guide to Microsoft Outlook 2007” or “The Lawyer’s Guide to Microsoft Word 2007”. Other than that I’ll be around all weekend, probably at the Conference Concierge desk most of the time and I’m happy to meet any conference attendees and talk about anything they’d like. Folks who know me know I rarely turn down a question on law technology. Or triathlon.

Call for Presentations: Legal Information Technology Conference 2010

ARMA International and ILTA invite you to submit presentation proposals for LIT-Con 2010-the premier event for mastering information governance throughout the law firm, organization, or corporation. “In Their Own Words” Legal Thought Leaders Spotlight: Ernie Svenson

ErnieSvensonWho are you?  What firm are you with?  What is your role?

Ernie Svenson.  I’m a solo lawyer in New Orleans, practicing commercial litigation like I did when I was with the large firm that I was with for 20 years. Actually, I practice the same kind of law, but much differently thanks to inexpensive technology and the Internet.

What is your firms’ specialty/niche? 

My speciality depends on your viewpoint.  To people who need a box to check, I specialize in business lawsuits, many of them related to franchise issues.  I also handle legal issues involving the Internet and general intellectual property disputes.  From my perspective, I specialize in figuring out how to manage information more effectively so that I can create leverage for my clients.  Many lawyers aren’t interested in processing information more intelligently and when I encounter an opponent with that approach I find that there are often opportunites to create a lot of leverage.

What do you see as the biggest challenge facing the legal technology industry now and in the upcoming year?

The biggest challenge for the legal tech industry is the same one it’s always had, and the same one it’s going to have until the next generation comes into the workforce: even though legal technology can help lawyers do a better job (sometimes even at a lower cost to the client), many lawyers resist embracing technology.  Lawyers are, by trade, a backward looking profession that values precedent more than innovation.  And we’re risk-averse.  So that’s the insidious challenge for folks who provide technology to lawyers.

How can the legal vendor community work with you best?

I’m easy to work with.  I usually know what I want, and when I don’t I know how to find the right folks to ask questions of.  Other lawyers need to develop a bond of trust with legal vendors, and unfortunately a few bad experiences only makes lawyers less inclined to embrace technology.  Kind of like that old saying: “it’s better to be silent and be thought a fool, than to open your mouth and remove all doubt.” Except in the world of tech vendors lawyers would probably say: “It’s better to do it the old-fashioned way and be thought a dinosaur, than to try to work with a vendor who pushes some new technology that winds up making you look like a complete idiot.”

What advice would you have for legal vendors trying to compete in this crowded marketplace?

Speak softly and don’t make any sudden moves or you’ll frighten the squirrels. Building trust with lawyers is harder than building trust with any other group. Lawyers are hyper-suspicous for lots of reasons, not the least of which is formal training.  When lawyers feel like they might be drawn into a position of weakness (i.e. not knowing about tech and talking to someone who does), they avoid that situation. They’re good at creating seemingly plausible reasons for that avoidance, and they won’t be drawn in easily.

Lawyers need to see the benefits of technology in a way that they understand, and they are more inclined to trust other lawyers.  And even though lawyers are the supreme masters of incomprehensible jargon, they don’t react favorably to it when some tech-vendor foists it on them.

What associations are you active in?

Inns of Court (which is a traditional legal association), and various online social media groups that are populated with folks who are looking for new ways of doing things.

What online resource (website, blog, etc.) is most useful to you (i.e., you use it everyday)?

There is no one website that I favor.  I’m a big believer in pulling trusted information from several sources, and then reading it in my RSS newsreader (which is Google Reader).  Last January I wrote a blog post called “Where I get my information” that describes a few of the sites I think are most useful.

What are you speaking about at ABA TECHSHOW?

I’m speaking on a couple of panels about how to be paperless: Developing The Paperless Habit (which is about the institutional and personal impediments to becoming paperless, and strategies for overcoming those impediments), and Acrobat for Power Users (about using Acrobat in advanced ways to manage information better, and –of course– achieve greater leverage and benefit for your client.  All of this tech stuff is useful only to the extent that we can do a better job of helping our clients.  I love TECHSHOW because I think it’s the best “one stop shop” for lawyers who want to learn about technology, and make contacts with lawyers and vendors who can help them do that quickly and with as little stress and drama as possible.

According to The Orange Rag, Steve Buege has decided to step down as CEO of Elite.  Kim Massana, senior vice president and general manager of Elite, will serve as President while they search for a CEO.
