InsideLegal Working on ILTA Vendor Program & ILTA’s Member Technology Purchasing Survey

We at InsideLegal have been working with ILTA's Program Director, Peggy Wechsler to update the 2010 ILTA Member Technology Purchasing Survey that spotlights the technology purchasing history and future plans for law firms with 50 attorneys and up. This will be the 5th year we have administered and produced the survey for ILTA and the survey findings will be presented by Jobst Elster, InsideLegal's Head of Content at the ILTA Annual Conference in August. You can review last year's survey here.

Also in the works is the Vendor Education Program that we produce each year at the ILTA Annual Conference. We will be offering sessions on Selling to Law Firms, Working with the Legal Media, Social Media, Review of the Technology Purchasing Survey, Working with ILTA, etc. If you have any suggestions for a topic you would like covered, please email us and let us know. We will be announcing the program details soon, but you can plan on attending Monday afternoon, 8/23.

Also, as you've probably heard by now, the ILTA Conference will be moving from it's planned location in Nashville due to the recent flooding. If you had already booked rooms for your team at the Gaylord in Nashville, ILTA has asked that you to contact the hotel to cancel the reservations. ILTA has selected another facility and is in the process of finalizing and will be announcing the new location soon. The show will go on!

In Their Own Words: Legal Administrators – The Law Firms’ Field Generals

ALA Annual Conference Last week, we attended the Association of Legal Administrator's 39th Annual Educational Conference & Exposition in Boston and judging by conference attendance, which was up approximately 40% to 1,300+ from 2009, the event was yet another indicator that the worst of the latest economic recession is behind us. In addition to the ideally located convention space (with close proximity to literally 100s of shops, restaurants and watering holes), the choice of Boston as host city attracted many for additional client networking and meeting opportunities.

The ALA show is like no other (except for maybe the ABA Annual) in our legal technology space because it offers much more than "just" technology solutions. Case in point, of the 192 exhibitors in Boston (vs. 186 in 2009), only 75 vendors (less than 40%) sold legal technology software/hardware/consulting services. Over 60% of the booths touted anything and everything involved with day-to-day law firm administration and office management ranging from architectural services to insurance products, office supplies, staffing providers and translation services.

This broad mix might surprise some, especially those unfamiliar with the expansive list of job duties handled by your 'typical' legal administrator (often also referred to as office manager, director of administration, executive director, office administrator or chief administrative officer).In connection with the ALA Annual, we though it fitting to further 'de-mystify' the legal administrator and explain what they care about, how they perceive technology and why they attend the annual conference. Some exhibitors have even argued that legal administrators are not the right audience for legal technology vendors since they only care about IT 'a little bit'. We decided to ask a few administrators and see if this is true:

IL: What are your daily job duties as an legal administrator…

Joan Wean - Legal Administrator, Hamburg, Rubin, Mullin, Maxwell & Lupin, PC:  I am responsible for the day-to-day administrative and personnel operations of HRMM&L, working directly with the Managing Partner. I assist in the development of operating policies and evaluation of growth opportunities within the firm and am involved in recommending a multitude of firm purchases ranging from liability insurance to office furniture. I have spent the last 18 years at the firm and currently support all 75 users including 30 attorneys. 

Glenda Raley - Cincinnati Office Administrator, Ulmer & Berne LLP: I am one of four administrators (reporting to the firm's executive director) supporting 175 attorneys across four offices in Ohio and Illinois. I truly do a little bit of everything and must be well versed in new technologies, new HR policies and the latest insurance options, just to name a few.

John S. Kirk - Director of Administration (& Chair of ALA Vendor Relations Committee) Manko, Gold, Katcher & Fox LLP: We wear many hats and juggle lots of responsibilities. In my case, there's roughly a 25% time split for HR, IT, Finance, and facilities management and general admin. Educating myself on new trends, new technologies, and policies is paramount to performing my job.

IL: What role do you play in the technology purchasing process?  How important is technology to you as an administrator? 

Joan Wean: Technology obviously plays a critical role in our firm but as far as day-to-day technology goes we rely on mindSHIFT for everything. They do it all in terms of IT services and hosting as well.

Glenda Raley: My biggest role in technology purchasing is that of end-user champion. I listen to what our users want and what they need to serve our clients and then communicate this to the appropriate decision makers and influencers. In terms of decision making, I make technology recommendations (again based on user feedback and what I see at shows like ALA) and take them to the firm's Executive Director.

John S. Kirk: Technology is no longer just a tool but touches on all facets of my daily firm work. I am constantly reaching out to vendors and educating myself on new tools and systems that will make our firm's operation more efficient and productive.

IL: Why did you attend the 2010 Annual ALA Conference & Expo?

Joan Wean: I look forward to the educational sessions and the business partner interaction during exhibit hall hours. 

Glenda Raley: I attend the annual conference to scope out new trends, network with peers, and spend time visiting vendors at the exhibit hall.

John S. Kirk: Education is as important as networking with peers and vendor partners. As chair of the vendor relations committee, I appreciate the partnering and interaction that takes place at conference between our members and business partners.

InnovAction Awards for Legal Innovation

COLPMThe InnovAction Awards is a worldwide search for lawyers, law firms, and other deliverers of legal services who are currently engaged in some extraordinarily innovative efforts. The goal is to demonstrate to the legal community what can be created when passionate professionals, with big ideas and strong convictions, are determined to make a difference. Each year (since 2005), the College of Law Practice Management (COLPM) presents the coveted InnovAction Awards to those unsung heroes and rising stars within the legal profession who dare to think differently and succeed by doing so.  The COLPM is an organization that was "founded to recognize distinguished law practice management professionals, to set standards of achievement for others in the profession, and to fund and assist projects that enhance the highest quality of law practice management."

Entry Information
Applications for the 2010 InnovAction Awards are now available.  All entries must be received by June 1, 2010 accompanied by a $325 US entry fee. 

Judging Criteria
Entries will be reviewed and selections made by the Award Selection Committee. The InnovAction Award entries will be judged based on the following criteria:

  • Absence of precedent (never been done, or done quite this way before)
  • Evidence of action (the innovation idea was transformed into action and not merely reflective of best intentions)
  • Effectiveness of innovation (there is some measurable outcome that indicates that the innovation is accomplishing what it was intended to do)
  • Action must have taken place within no more than three years prior to this entry

The 2010 InnovAction Award winners will receive their InnovAction Awards at the College of Law Practice Management's Annual Conference to be held in conjunction with the College's Annual Meeting in Washington, DC on October 22 – 23, 2010.  You can read about the winners from 2009 here.

ILTA INSIGHT London 2010 Recap

Another legal technology event “in the books” and, as usual, ILTA never disappoints. ILTA INSIGHT, celebrating its fifth year, was held April 27th in London.  InsideLegal has been attending the ILTA event in the US for the past 11 years, but this was our first time at ILTA INSIGHT. Although the UK version is much smaller, the quality of the educational sessions, speakers and networking were up to par with the US Annual Conference held in August. While the credit for that is shared amongst the planning committee, speakers and sponsors, we attributed most of it to the ILTA staff – Peggy Wechsler and Judy Couvillion.  As usual, they had every detail covered and made sure that people knew where to be, when to be in sessions and spent a great deal of time facilitating introductions and making the attendees feel at home. 

Peggy Wechsler (ILTA) & Lance Waagner (Intelliteach)We’ll start with the Speakers/Board dinner that took place the night before the event and was attended by the INSIGHT planning committee and most of the event’s speakers.  The reception and dinner was sponsored by Lance Waagner, CEO of Intelliteach – the legal specific service desk outsourcing vendor that has recently opened an office in London – and was organized by Peggy Wechsler.  I had the pleasure of being at one end of the table with Chris Dale of e-Disclosure Information Project; Peter Attwood of Simmons & Simmons; Jonathan Maas of Ernst & Young’s Forensic Technology & Discovery Services team; Steven Whitaker, Senior Master of the Senior Courts of England and Wales in the Queen’s Bench Division; and Peggy.  The evening was a success: good food, great company and wonderful energy that would set the tone for Tuesday’s conference.

The next morning began with the keynote by David Morley, Senior Partner at Allen & Overy LLP.  Prior commitments prohibited us from attending, but the delegates were still discussing the keynote well into the morning sessions. Also, fellow “INSIGHTer” Chris Dale provided a thoughtful event recap including a few observation’s on the day’s keynote. 

Steven Whitaker (Senior Courts of England and Wales) & Chris Dale (e-Disclosure Information Project)The morning sessions included Tools and Techniques for the Facebook Generation; The Evolution of Office (moderated by Nigel Blackwood of Wragge & Co.); Transforming our Business (BPM, BPA and BI) (moderated by The Orange Rag’s Charles Christian); and The Future of the Traditional Desktop (moderated by Sidley Austin’s Joy Heath Rush).  The afternoon kicked off with LITIG’s Review of Case and Matter Management Systems (moderated by Peter Owen of Lights-On Consulting); Electronic Working in the Royal Courts of Justice (Nigel Kelly of Her Majesty’s Courts Service); 21st Century Collaboration (moderated by Joy Heath Rush); and Technology as a Component in Lord Justice’s e-Disclosure Recommendations (by Chris Dale & Master Steven Whitaker).

ILTA President Scott Christensen (Wildman, Harrold, Allen and Dixon) & INSIGHT Event Chair Janet Day (Berwin Leighton Paisner)The day ended with a recap session led by ILTA’s President, Scott Christensen of Wildman, Harrold, Allen and Dixon and the ILTA INSIGHT Conference Chair, Janet Day of Berwin Leighton Paisner. A networking reception followed providing all delegates another opportunity to mingle with peers and follow-up on the day’s 8 sessions. In our opinion, networking at INSIGHT was second to none and one of the intangibles that sets this event apart.

Rupert Collins-White & Sarah Cox (Legal Support Network)In addition, the ILTA program gave us the opportunity to meet new friends and catch up with old ones. First on the agenda, was meeting with Rupert White-Collins, Head of Content & Community, and Sarah Cox, Head of Client Services, for Legal Support Network.  Legal Support Network is a community website for UK law firm professionals and organizer of popular regional legal networking events.  Rupert recently joined LSN from Law Society Gazette and in his new role encourages online discussions and conversations particularly via the network’s LinkedIn group. We also had the opportunity to meet Daniel Brown, CEO of TheKnowList which hosts TheKnowList Awards in London; Andrew Haslam, Project Coordinator at Lovells & Lead Consultant at Allvision Computing; and Darren Armstrong and Frances Anderson of Netlaw Media who are preparing for their event, Strategic Leadership Forum 2010 on June 16 in London.

For us, ILTA INSIGHT 2010 provided just that, insight into the UK legal IT market and a very hands-on opportunity to get to know our UK counterparts. 2010 was our first, but definitely not our last ILTA INSIGHT.

In Their Own Words: Law Firm Innovators Bradford & Barthel’s “Operation Google Apps”

ILTA INSIGHT Panel - The Future of the Traditional Desktop InsideLegal attended ILTA's INSIGHT London event last week and was particularly impressed with the session focused on the future (or end of) the traditional desktop. This panel discussion was moderated by Joy Heath Rush of Sidley Austin and included Tim Warburton of Linklaters; Eric Hunter of Bradford & Barthel; and David Hamilton of Davies Arnold Cooper. Most notably, we (and the rest of the INSIGHT crowd) took notice of one of the first 'real world' legal examples (as far as we can tell) of cloud computing and what is possible when law firms visualize and eventually realize the opportunities made available by cloud-based platforms and true collaboration suites. With that said, we recently had a one-on-one with Eric Hunter, Director of Knowledge Management for California-based Bradford & Barthel LLP, a 73 attorney (207 employee) firm, which has embraced Google Apps.

IL:  Welcome Eric. Thanks for taking time to chat with us about how Bradford & Brathel is computing "in the cloud" and why, after a few short days at ILTA's INSIGHT London conference, you have earned the new nickname "Google Apps Eric". For starters, give us a bit of background on your firm, role and job duties.

B&B:
 Founded in 1997 by Thomas Bradford and Donald Barthel, Bradford & Barthel, LLP (B&B) is the industry leader in the aggressive defense of Workers' Compensation, Subrogation, and Employment, and Labor matters. B&B's 73 attorneys (on a growth path to 85 by the end of 2010) are spread throughout its 12 California offices. I have been with the firm since 2005 and prior to my current position as KM Director have been involved in project management and as developer/administrator for the firm's ADERANT Expert financial management solution. It is also worth noting that my current role is a hybrid of IT and KM and that all 6 of our IT/KM group members led by firm management see the value of integrating technology and KM via our Google Apps strategy. I am also a big ILTA supporter and currently serve as track chair on the annual conference planning committee.

IL:  What was the business case for moving B&B to the cloud? 

B&B:  The firm had a real need to find more cost effective, collaborative, flexible and efficient options for communicating and sharing files and information trapped in disparate systems, in documents on desktops, and in a multitude of electronic communications. We looked at the risk management aspects of going to a software-as-as-service model versus the additional infrastructure (servers and the like) and licensing considerations if we went the standard MS Office upgrade route. Upon review of various collaboration suites including Google Apps and the associated real-world benefits (vs. the risks), the senior management team gave us the green light to move forward with a cloud strategy.

IL: Can you detail your Google Apps roadmap?

B&B: Sure. B&B's cloud roadmap is based on a 24 month execution plan touching our users' critical applications and workflows including email, calendaring, intranet, extranet, video, documents, spreadsheets, presentations, and document management system. Phase 1 which has been LIVE since April 16th included hosted exchange, intranet and calendaring and, after some pilot testing in February, was rolled out firm-wide within 30 days in March. Phase 2 includes our documentation solution (Google Docs) and will involve a complete switch from MS Office to web-based, collaborative documents, spreadsheets and presentations. This will be complete by fall (end of Q3, beginning of Q4). The 3rd and final phase involves the creation of a cloud based document management system leveraging the entire Google Apps Collaboration Suite and will commence in Q1 2011 and should take 12 months to complete.

IL: How did you create buy-in for your Google Apps strategy across the firm and the 200+ user base?

B&B: We wasted no time communicating this to all users and went office-to-office talking about the roadmap and introducing the overall concept. We also established weekly webinars to ease the transition and learning curve. By getting support and buy-in from management and department heads early, we had the leverage necessary to implement change.  As an aside, since our Phase 1 roll-out, we have gotten exclusively positive feedback and comments from our users.

IL: Can you list the biggest benefits you have already realized since the initial Google Apps roll-out and cite any specific ROI/cost savings? 

B&B: Substantial benefits include user collaboration; licensing and hardware-related cost savings; IT resource savings; B&B's ability to build-out a true KM solution based on technology (Google Apps); user access and mobility; and 99.9% uptime reliability (a Google Apps guarantee). Also, in terms of ROI, we determined that the annual subscription model – $50 per collaboration suite user and $13 per email archiving user – is projected to provide a cost savings of 10:1 versus our previous solution. In terms of the aforementioned user collaboration, we currently (as part of Phase 1) use the video and voice chat feature combined with document sharing for video, training and web meetings, both internally and with our clients.

IL: What words of wisdom do you have for your law firm peers looking to deploy a collaboration suite such as Google Apps?

B&B: Fortunately there are a lot of cloud computing resources, but I advise to focus on these five points in particular:

  1. Look at the available collaboration suites to see what best suits the firm. Also, take Google Apps and the others for a test drive. At $50 per user it won't break the bank to set up a testing environment and see if a cloud setup would work firm-wide. 
  2. Analyze exisiting infrastructure and determine a realistic migration time table.
  3. Look at the firm's current business model: How do you currently communciate with users and clients? How can you re-distribute and share info to maximize collaboration and how will this change the firm's business process.
  4. Take a hard look at how data is stored and how this will effect the firm. For example, UK/European firms need to know where data is stored based on their clients' regional regulations. Also, clients need to be educated on how data is stored and secured.
  5. Assuming cloud data security is accounted for with heavy hitter vendors such as Google and Microsoft, firms should focus on application integration and how cloud offerings can integrate with bread and butter systems such as time & billing and accounting software.

Sizing up the U.S. Law Firm Market: Pulling back the covers on stats, rankings, projections and associations that matter (to be continued)

When we first got our feet wet in legal over 12 years ago, our initial quest was a simple one …"get to know the key players in this industry, find out how many law firms there are, drill down into market size and trends, and walk away with an accurate statistical picture of the US legal landscape." While our aim back then was absolutely pure and true, we failed miserably at sourcing this info and couldn't find anyone or any institution who had such data at their fingertips. We began to scratch and dig for tidbits of info and slowly but surely began compiling our version of the legal market tip sheet. We published our first "U.S. Legal Industry Overview: Understanding the Landscape" summary (never more than a double sided sheet) in 2004 and have continued most years (we too experience "writers/researchers block") since then. Again, the goal was, and remains, not to create a monstrous research project around the U.S. law firm landscape, but to aggregate a variety of sources (law firm rankings, technology surveys, association reports, consultant market advisories) that already existed, polish things up a bit, and make them widely available. Fast forward to 2010, there still is not a single source (besides back issues of our since retired  LegalMarketingNews newsletter), and yes, the same questions still remain, largely unanswered.

With this bit of history, what you'll read below is a compilation of legal market stats, facts, and surveys meant to enlighten and inform, not provide a "silver research bullet". What you'll see here over the coming weeks is a "greatest hits" version of relevant stats and facts starting with U.S. firm statistics and law firm rankings & lists. In addition, we'll focus on the legal 'business' landscape, the Canadian legal market, the UK legal landscape and eventually end up in Australia.

North American Firm Size Statistics 2010   (Sources: Zap Data (a division of Dunn & Bradstreet))

  • There are approximately 1,320 law firms in North America with 100 employees or more (~40+ attorneys). Of those, 366 firms have 250 employees or more (~100+ attorneys).
  • Firms with 100 employees or more account for roughly 0.4% of the entire U.S. law firm market. 
  • 68% of all U.S. firms have 2 to 4 employees, 3% higher than in 2007.
  • 91% of all U.S. firms and legal service providers have less than 10 employees (approximately 4 attorneys).
  • According to the ABA Market Research Department, there are 1,180,386 licensed lawyers’ in the U.S., and roughly 1.5 million legal professionals total including legal administrators, paralegals, IT, etc.

  • Am Law 100: 2009 ranking of America’s top 100 revenue grossing law firms included 13 firms exceeding the $1 billion mark. Skadden leads the pack with $2.2 Billion in gross revenue. 
  • Am Law 200: 2009 rankings range from Bracewell & Giuliani’s $275.5 million to Morris, Manning’s $99 million gross to round out the 200.
  • Global 100:Consists of 75 U.S.-based firms and 16 from the UK including the top three – Clifford Chance, Linklaters and Freshfields. 
  • NLJ 250: National Law Journal’s 2009 list of largest law firms based on number of attorneys includes DLA Piper at the top (3,785) and Nexsen Pruet at 250 with 174 lawyers. 

Technology Surveys

  • 2009 InsideLegal/ILTA Member Technology Purchasing Survey:  The 9th annual ILTA Member Technology Purchasing Survey includes feedback from 115 ILTA member law firms with 50 or more attorneys, and covers IT budgeting; technology purchasing patterns; selection criteria; purchase influencers; technology trends & IT challenges; and state-of-the-economy questions. 
  • ILTA’s 2009 Technology Survey:  2009 included 455 respondents representing 88,000 attorneys and 190,000 end users with 31% of responses coming from “under 50” attorney firms. The survey is exclusively focused on the statistics and numbers pertaining to all technologies used in ILTA law firms. 
  • 2009 ABA Legal Technology Survey Report: Produced by ABA’s Legal Technology Resource Center, the survey consists of 6 volumes including technology basics, law office technology, litigation and courtroom technology, web and communication technology, online research and mobile lawyers.
  • 2009 Case, Matter, and Practice Management System Software Study: The ‘CMS Study’ is produced by the University of Florida Levin College of Law's Legal Technology Institute and features a 320 page report detailing current use and future trends of legal case, matter and practice management systems.

ILTA INSIGHT London Preview

ILTAWe're off to London for next Tuesday's INSIGHT 2010 event, the International Legal Technology Association's (ILTA) 5th annual legal IT thought leadership meeting in the UK. INSIGHT is an all day event (9am-4:30pm sessions, 4:30-6:30pm reception) drawing nearly 200 law firm and law department professionals convened to hear from leading technologists and business strategists, from the UK and the US. This year, INSIGHT features 27 reputable speakers sharing their expertise on various topics focused on the overall theme "2020 Foresight: The future of legal IT".

No ILTA event would be complete without the loyal support and partnership from the legal technology vendor community and INSIGHT 2010 is no exception. 29 vendors have given their support consisting of a mix of UK-based companies and US organizations with European offices spanning numerous application & service areas including practice management, time & billing, document management, compliance, training, service desk outsourcing, compliance, risk management and IT/technology consulting. Also, to our knowledge, NO e-discovery/litigation support companies are signed up – simply a reflection of the moderate interest/importance of "e-disclosure" outside the US or something bigger?

There are 8 INSIGHT sessions offered via 2 concurrent educational tracks including:

  • The Evolution of Office
  • Traversing the Generation Divide
  • Business Processes (BPM, BPA and BI)
  • The Future of the Traditional Desktop
  • 21st Century Collaboration
  • The Electronic Working in the RCJ
  • Electronic Evidence – Preservation to Production 
  • Presentation by LITIG on their Review of Case and Matter Management Systems

All of these sessions are bound to spark discussion and engage the delegates. We are particularly looking forward to the keynote address by David Morley, a Senior Partner at Allen & Overy LLP, who will launch INSIGHT 2010 with a thought-provoking look at the power of IT to transform the legal profession. The brochure mentions that "… IT can create magic for clients without the smoke and mirrors" so hopefully we'll walk away charmed.
